She says she mistook his apartment for her home, encountered Jean, and eventually shot him. She saw a figure in the dark and fired her weapon after Jean did not obey her verbal commands.
Merritt said the district attorney's investigators may be unsure whether Guyger is being forthcoming in her statements and are looking for evidence that will either prove or disprove her version of events.
Many have complained about the police giving Guyger special treatment.
It's not clear whose weed it was, but a civil rights attorney representing Jean's family says the department's motives to search for "narcotics" were all too clear. It took days for law enforcement officials to arrest her. "Fearful officers make hasty decisions and bad decisions". "This was an intent to come after this young man's character, which is impeccable by the way".
The affidavit claims Guyger only realized she was in the wrong apartment when 911 dispatchers asked for the location of the shooting. Her apartment is directly beneath Jean's.
"It's a mistake to dismiss something out of hand simply because.it appears to be implausible or inexplicable", he said.
Merritt also demanded that Dallas Police Chief Renee Hall launch an internal investigation into who is leaking information that is assassinating Botham's character.
And in the case of 18-year-old Michael Brown, shot to death by police officer Darren Wilson in Ferguson, Missouri, in 2014, police zeroed in on Brown's alleged attempt to steal cigars from a convenience store prior to the shooting, while critics fired back that it had nothing to do with it.
"In general, the more similar things are, the more likely such confusion can arise", Radvansky said. They include whether Guyger was under the influence of alcohol or drugs, her level of fatigue, any history of emotional or medical problems, or any history she may have had with Jean, though initial reports suggested the two did not know each other.
From St. Lucia to a small Christian college in Arkansas and to the offices of PricewaterhouseCoopers in Texas, the 26-year-old man was remembered as a loving son and brother, a hard worker and a powerful singer who enjoyed helping others.
"He could be having the same reaction: 'Oh my God, somebody's coming in my apartment".
"You go ahead and put it in there just in case you find it", Mulder said.
His mother, Allison Jean, recalled her son's commitment to his faith at a prayer vigil last weekend.
